A GLASS bottling factory built without planning permission has got nine months to cease production.
Cheshire West and Chester Council (CWAC) has served an enforcement notice on Quinn Glass, Elton, to comply with High Court action brought by trade rivals Ardagh Glass.
But Quinn is appealing the move, arguing the council failed to determine a retrospective planning application to regularise the existing development submitted last January.
The enforcement notice also requires demolition of unauthorised buildings within 18 months and restoration of the site to its original condition within 24 months.
The enforcement notice does not take effect until May 29.
In the meantime, Quinn Glass will lodge an appeal at which the point the clock stops in terms of meeting the stated deadlines.
CWAC is awaiting further information from Quinn before deciding when the retrospective planning application will go before committee.
