A WREXHAM man who admitted assaulting his neighbour by striking him to the back with a metal baseball bat has been sentenced to two months in prison.

But it meant Lee Anthony Davies' immediate release from jail because of the time he had served on remand.

Davies had denied assaulting Darren Keith Bennett during an incident in March and a trial was due to be held today at Mold Crown Court.

But the prosecution asked for an adjournment after the witnesses failed to turn up and the court was told that Mr

Bennett did not wish to give evidence.

However, after a break, Davies of Vale View, Southsea, returned to the dock and pleaded guilty.

Judge John Rogers QC said if Davies had used the bar on the head, or if there had been any follow-up assault, then it would have been a far more serious matter.

However, he would be given full credit for his guilty plea, entered in the knowledge there was a possibility he would not be convicted given the reluctance of Mr Bennett to give evidence.

And the judge said he also took into account that Davies had been in custody since March, partly for the assault and partly for a robbery allegation for which he had been cleared.

The court heard that the assault occurred in Brynteg when Davies approached with a metal baseball bat and struck Mr Bennett to the back, causing bruising.

He then walked away still holding the weapon, which was later recovered by police from his home.
