A GLASS bottling company was this week due to appeal a planning enforcement notice ordering the factory to cease production within nine months.

Quinn Glass will lodge an appeal with the Planning Inspectorate by tomorrow with respect to its factory at Elton, which was built without planning permission.

Cheshire West and Chester Council (CWAC) served the enforcement notice to comply with High Court action brought by trade rival Ardagh Glass.

Quinn’s appeal is believed to be based on the argument that the local authority failed to determine a retrospective planning application to regularise the existing development submitted last January.

The enforcement notice also requires demolition of unauthorised buildings within 18 months and restoration of the site to its original condition within 24 months.

CWAC is awaiting further information from Quinn before deciding when the retrospective planning application will go before committee. Communities secretary Hazel Blears reserves the right to decide the matter herself.
