A PARTYGOER who took his friend's car and drove it when he was more than three times the legal limit has been jailed for 118 days.

Richard Steven Ogden, 25, admitted drink-driving, driving while disqualified, no insurance, taking a vehicle without consent and resisting or obstructing a constable in the execution of his duty.

Charges of failing to supply a breath specimen and assaulting a police officer were withdrawn at Chester, Ellesmere Port & Neston Magistrates Court.

Simon Schwarz, prosecuting, said police were called to a house in Fulwood Road, Little Sutton, at 4.10am on April 8.

'There was a disturbance in that area at that time. The defendant came from a house and spoke to officers. He said he had been thrown out of a party,' he said. 'His condition was one of being drunk.'

Five minutes later the officers spotted Ogden, of Kings Mews, Little Sutton, driving a Peugeot 106 and followed him into nearby Glenwood Close where they asked his to give a breath test.

'After two failed attempts Ogden was told he was under arrest, but he tried to run off pushing one of the officers to the floor,' said Mr Schwarz. Later Ogden gave a reading of 109mg of alcohol in 100ml of breath. The legal limit is 35mg.

Ogden was also charged with criminal damage on March 31 after he smashed the windscreen of a Ford Sierra.

Defending, Ian Sharples said Ogden had addressed his alcohol problem and was beginning to get his life back on track.

'He is a working lad. He is in the process of starting a new family,' he said. 'You have a different person in front of you today than the person who committed these offences.'

District Judge Philip Dodd, who also banned Ogden from driving for four years, said: 'You were three times the limit and you have got to appreciate that drink and driving cars kills people.'
