A MAN who deliberately 'glassed' his own uncle with a beer glass escaped a prison sentence.

Kevin David Mitchell, 26, miraculously only caused a scratch to his uncle Brian Mitchell's ear.

He was heard to say: 'I am going to put this glass in Brian's face. Do you think he will like it?'

The judge, Mr Recorder Nic Parry, told Mitchell, of Parklands, Little Sutton, he must have a nasty streak.

Mitchell admitted assault following the incident on Christmas Eve 2004. The prosecution indicated there had been an 'inexcusable delay' in the case.

At Mold Crown Court, Mitchell was ordered to carry out 200 hours' un-paid work and pay his uncle £150 compensation.

Mr Parry told him: 'You must have a very nasty streak in your character to be able to smash a glass into someone's face. What is more deplorable is that you made a conscious decision to do that.'

The judge said if Mitchell had caused the type of injuries that would be expected from such an attack, then he would have been going to prison for at least four years.

The judge added the delay was something he took into account in sentencing and accepted it was nothing whatsoever to do with Mitchell.

Prosecuting, Matthew Corbett Jones said the incident took place at The Clwyd Hotel, Shotton, on December 24, 2004.

Simon Leong, defending, said Mitchell was clearly affected by drink. He was a hard worker and had no convictions for violence - and the delay meant the case had been hanging over him for a long time.
