A Polish van driver who was jailed last week for causing the death of a popular cyclist by careless driving has been sentenced for failing to stop after the fatal A483 collision.

Damian Niepieklo, 22, was handed a three-month prison sentence for the offence and banned from driving for six months when he appeared at Wrexham Magistrates Court on Wednesday.

The prison sentence will start on Wednesday and run concurrently with the 12-month jail term he received on Friday at Mold Crown Court for causing the death of 60-year-old Alan Desmond Cronin by careless driving.

Niepieklo received no separate penalty for the second offence of failing to report a road accident.

Mr Cronin, from Guilden Sutton, was killed instantly when he was struck by the defendant’s Fiat Ducato van on the A483 northbound carriageway near the Rossett fly-over on June 11 this year.

Niepieklo was originally charged with causing death by dangerous driving, but that was dropped by the prosecution when he admitted careless driving.

The van driver, who had only arrived in the UK the day before the accident and was making a series of deliveries, denied failing to stop and failing to report the accident.

But at a trial in the magistrates court last month he was convicted of the offences.

Sentencing Niepieklo, deputy district judge David Murray said: “It is unfortunate that these matters were not resolved at the crown court, not least because Mr Cronin’s family could have had all matters settled on that day.“

"Your behaviour was so serious only custody can be justified. I’m conscious that my learned judge did take these offences as aggravating features and on the face of it increased the starting point of the sentence.

“I’m also conscious and take into account the need to avoid double jeopardy. You can have no credit because you contested the trial.”

Melissa Griffiths, defending Niepieklo, said: “This is a very emotive case and no sentence can make up for the loss of Mr Cronin.

“The defendant addressed the judge personally at last week’s hearing to convey his sorrow at what had happened.”

Niepieklo, who will be deported upon his release, was also ordered to pay a £520 criminal court charge and a victim surcharge of £80.
