Footballer Ched Evans denies raping a teenager at a hotel and is today due to continue giving evidence.

The alleged incident occurred at a Premier Inn near Rhyl in the early hours of Monday, May 30 in 2011.

Yesterday, the 27-year-old accepted: "Looking back, my behaviour wasn’t the best and I shouldn’t have behaved that way.”

The alleged victim was 19 at the time and prosecutors argue she was too drunk to consent to sex.

Evans' case is that she was having intercourse with his friend Clayton McDonald and agreed he could "join in".

Mr McDonald was found not guilty by a jury at an original trial at Caernarfon Crown Court .

Evans was allowed to appeal his conviction and this is the re-trial.

Witness says he believes complainant is "lying"

The witness claimed the alleged victim said “f*** me harder” while they were having sex, two weeks after the alleged rape.

Prosecutor Simon Medland QC suggested he had invented the evidence to help Evans and claim a reward of £50,000 offered on the Ched Evans website.

The witness said he had a “clear recollection” of those words being said and “no doubt at all”.

Defence barrister Judith Khan QC asked: “Are you here in some way motivated by the hope of a reward?”

The witness replied: “No.”

Ms Khan said: “It is being suggested you are giving perjured evidence - lying on oath.”

The witness said that was not true.

The defence barrister asked: “Did you ever ask about a reward? Have you ever sought to claim a reward?”

The witness said: “No.”

Ms Khan added: “Why are you giving evidence?”

The witness responded: “Because I believe that she (the complainant) is lying.”

Ms Khan said: “Did you come here to tell this jury a pack of lies?”

He replied: “No.”

Witness told police about sex with complainant

Defence barrister Judith Khan QC is now re-examining the witness, who can’t be named for legal reasons.

The court heard he told police on April 20, 2012, that he’d had sex with the complainant two weeks after the alleged rape.

The witness said he would have included more details in his original statement if he had been asked more specific questions.

Witness denies receiving money for giving evidence

The man said he did not offer to put himself forward as a witness until after Evans was convicted, because he felt he had no information “of relevance or value”.

The court heard he has since put forward three statements to defence solicitors.

Mr Medland is asking about discrepancies between his three statements.

The prosecutor asked: “Were you aware of considerable disquiet about Ched Evans being convicted of rape. It was the talk of the town wasn’t it?”

The witness agreed.

Mr Medland asked if he was aware of a Ched Evans website, which offered a reward of £50,000 for evidence that could lead to Evans’ acquittal.

The prosecutor said: “In light of the evidence you gave in the Court of Appeal, have you received any money?”

The witness said he had not received any money.

Mr Medland added: “Would you agree with me that £50,000 is a lot of money?”

The man answered: “Yes.”

The prosecutor put it to the witness that he had “invented” evidence to help Evans, which the witness denied.

Mr Medland said: “I am going to suggest you have made that (evidence) up deliberately to help the defendant.2

The witness replied: “No.”

Evans put "fingers to lips" when entering room

The prosecutor is asking Mr Roberts about the light levels in the hotel room.

He said: “The room into which you were looking was very dark, wasn’t it?”

The witness confirmed there were no lights on and Clayton McDonald used the torch on his phone.

The court heard Evans put his fingers to his lips, as if telling his brother to keep quiet and Mr McDonald then closed the curtains.

Mr Roberts and friend filmed complainant having sex with Mr McDonald

The prosecutor is now asking why Mr Roberts and his friend filmed Clayton McDonald and the complainant having sex.

He said: “You would no doubt agree that sexual relations between people are deeply intimate, aren’t they?

“If somebody was going to film you having sex, you would want to give them your permission, wouldn’t you?

“Did you stop to think how embarrassing it would be for the woman having sex?”

Mr Robert’s said: “At the time no, but obviously I realise that now.”

The court heard his friend described the woman as “some fat bird” as they filmed the pair in the hotel room.

The prosecutor said: “To you both, she was just ‘some fat bird’ you were entitled to film having sex?”

Mr Roberts said he did not agree.

Evans's brother was "drunk, but not very drunk"

Mr Roberts is now being cross-examined by prosecutor Simon Medland QC.

The witness told the court he drank between 10 and 15 Jack Daniels and Cokes during the night out in Rhyl.

He said: “I was drunk, but not very drunk.”

The prosecutor is summarising Mr Robert’s police statements.

He read out an extract in which the witness told officers he, his brother and a friend took a taxi from the Godfather take-away to the Premier Inn to see where Clayton was.

The prosecutor asked why there was no mention of St Asaph police station.

The witness said he later amended his statement.

Evans' brother made first police statement in front of mother

Defence barrister Judith Khan QC is asking Mr Roberts questions about his police statements.

The court heard he made his first statement on May 31, 2011, at home with his mother present.

He told the court he initially thought police were there to ask him about the incident involving his friend at the take away.

When asked why he did not mention looking through the hotel window, he said: “My mum was there and I was embarrassed.”

Mr Roberts said he later went to Rhyl police station and gave police fuller details about what he saw at the Premier Inn.

Evans' brother says complainant seemed to be "enjoying" sex

Asked about how the complainant seemed, Mr Roberts said: “It seemed to me like she was enjoying the sex that was taking place.”

Ms Khan said: “Did it look to you as if she was incapacitated in any way?”

He replied: “No, she was fully participating.”

The defence barrister asked: “Was she aware of your presence outside the window?”

He added: “In the hear of the passion, maybe she did, maybe she didn’t. I can’t comment on what she saw.”

Mr Roberts says he "cringes" about his behaviour on night

Defence barrister Judith Khan QC asks Ryan Roberts how he feels about behaviour now.

He replied: “To be honest it makes me cringe at what I did, looking through people’s windows.

“At the time, I thought it was funny, but looking back it was immature and sill.”

Asked if that is how he would behave now, in similar circumstances, he said: “No, never.”

Evans' brother said he "giggled" when he saw him in room

Mr Roberts said he and his friend went back to the window and the curtains opened again.

Asked what he saw, he said: “I could see Clayton having sex with the girl. She was on all fours and he was behind her.

“I remember looking and seeing Ched behind them. He saw us and we started giggling.

“We were quiet and watched as Clayton had sex with this girl for a little bit longer, then he came over and shut the curtains again.”

The court heard Mr McDonald and the woman were both naked.

Mr Roberts said he received a text from his brother saying: “You can go home, I’ll follow you.”

He told the jury he and his friend got back in the taxi and went home to Rhyl.

Mr Roberts said his brother wanted to "have a look" in room

Defence barrister Judith Khan QC is now asking Mr Roberts about what he saw when he looked through the window.

He recalled seeing Clayton McDonald and a woman inside “having sex”.

He added: “I could see the girl on the bed, on all fours, and they were having consensual sex.”

Asked why he believed the sex to be consensual, he said: “She appeared to be enjoying it.”

The court heard Mr McDonald came to the window and closed the curtains.

Mr Roberts said he and his friend walked back to reception and told Evans that Mr McDonald was in the room “with a girl”.

He added: “I think he said he was going to have in and have a look.”

Evans' brother says they were "young and stupid"

The court heard Evans, and his brother and another friend got into a taxi outside The Godfather take-away.

Mr Roberts told the court his brother initially asked the driver to take them to St Aspah. as they were hoping to help their friend who had been arrested.

He added Evans then asked the driver to “divert” to the Premier Inn, but did not know why.

Asked why they had taken the diversion, Mr Roberts said: “I think Clayton was there.”

He said: “When we arrived, we went to the window to see if Clayton was there.”

When asked why he looked through the window, he replied: “I have no idea. We were young and stupid at the time.”

Asked what he was expecting to see, he said: “I didn’t expect to see anything, to be honest.”

Evans' brother says friend was arrested at take-away

Recalling the evening of Sunday, May 29, 2011, Mr Roberts said he finished his shift and went home to change.

He then went to meet Evans and his friends, including Clayton McDonald, in Rendez Vous bar in Rhyl.

The witness said he drank around six glasses of Jack Daniels and Coke in that bar, before the group moved on to Zu Bar.

Mr Roberts recalled drinking four or five more glasses of Jack Daniels and Coke in Zu Bar and then they went to The Godfather take-away.

He told the court there was an incident at the take-away, which resulted in one of their friends being arrested.

The witness said a woman headbutted his friend, who retaliated, before being taken away by the police.

Evans' brother Ryan Roberts gives evidence

The next defence witness is the defendant’s brother Ryan Roberts, who was 18 at the time and is now 23.

He is Evans’ younger half-brother.

The court heard he was a student in the second year of his A-Levels at the time of the alleged incident.

He has since studied maths at Swansea University and achieved a First and now works as a secondary school teacher.

The court heard he used to work part-time at a hotel and was living at his mother’s house in Ronaldsway in Rhyl.

Taxi driver is cross-examined

Taxi driver Simon Larkin is now being cross-examined by prosecutor Simon Medland QC.

The witness confirmed the men initially asked to go to St Asaph.

Mr Medland asked: “Not one mentioned anything about a police station, did they?”

The taxi driver confirmed they did not.

The witness said the whole journey lasted for about 40 minutes.

Taxi driver says he took group to hotel

Asked about what happened when they arrived at the Premier Inn, the taxi driver said: “One of the lads got out and went into reception.”

The witness said he did not know who Ched Evans was at the time.

He added the other two men then got out and “hovered” next to a hotel window.

Mr Larking added: “They appeared to be looking through the window. They were there for a while and I was getting a bit frustrated.

“I started the engine and they indicated they were only going to be a minute.

“A few minutes later, maybe 10 minutes later, I shouted ‘are you coming over, or what?’

“Then they started to walk towards me, straight past and into the reception of the Premier Inn.

“The security guard came out. The two lads came out, got back in the taxi and we went back to Rhyl.”

He said he dropped them off in Rhyl around 5am, as it was starting to get light.

The taxi driver said he did not see Evans again.

Next witness, a taxi driver, takes to the witness box

Court is now back in session.

The next defence witness is taxi driver Simon Larkin, who was working as a night driver in Rhyl at the time if the alleged incident.

The court heard he was driving a Peugeot Expert taxi overnight between Sunday, may 29, and Monday, May 30, in 2011 - a bank holiday weekend.

Mr Larkin drove Evans, his brother and friend from the The Godfather take-away in Rhyl to the Premier Inn in Rhuddlan.

The witness said the passengers paid him £20 for the journey.

He said they initially asked to go to St Aspah and he started driving them there.

Mr Larkin said he could not clearly hear the conversation between the passengers.

He added: “I vaguely heard something about a stag night and some mention of the Premier Inn.”

The court heard one of the passengers then asked him to turn left at a roundabout towards the Premier Inn in Rhuddlan.

Cross-examination over, Evans being re-examined by his barrister

Evans is now being re-examined by his barrister Judith Khan QC.

Asked about how drunk the alleged victim seemed, he said: “She was in control, she was taking charge of the sexual positions, she was giving commands out.

“She seemed like she’d had a drink, but no more drunk than me or Clayton.”

Evans told the court the woman asked him to perform oral sex on her.

Ms Khans said: “Did you have any concerns about whether or not she was consenting?”

He replied: “No.”

Ms Khan added: “Was there any concern on your part that she didn’t want to have sex?”

Evans replied: “No. I just thought she was enjoying herself. She was getting in positions and she was taking charge.

“I thought she was enjoying what she was doing.”

Ms Khan said: “Did you have any concerns about whether she was consenting or not?

He replied: “I didn’t have any concerns whatsoever.”

The defence barrister added: “If you had had any concerns about that, would you have had sex with her?”

Evans responded: “No, I wouldn’t have sex with anyone who wasn’t consenting.”

Prosecutor says Evans felt "entitled"

The prosecutor said: “I am going to suggest that you felt in some way entitled to behave in that way with (the complainant)?”

Evans replied: “I would never treat a girl like that.”

The court heard he told police in interview: “footballers are rich, they’ve got money, that’s what girls like.”

The prosecutor said: “You felt at the time that football was a magnet for girls, didn’t you?”

Evans replied: “Looking back on that statement, it’s cringe worthy. I don’t think footballers are entitled to anything.”

Mr Medland said: “Disinhibited through drink, you felt entitled to behave like that with that 19-year-old, didn’t you?”

The defendant responded: “No, I would never behave like that.”

Evans walked home with snapped ligaments in left ankle

The prosecutor is now asking about how Evans walked from the Premier Inn to his mother’s house.

The jury have been handed another map.

Mr Medland said: “At the time, you were not in terribly good health, were you?”

The court heard Evans had snapped ligaments in his left ankle.

The prosecutor added: “You had been hopping about in Rhyl on account of that injury?

“Why did you and Clayton choose to walk two miles from the hotel when you could have got a cab?”

Evans replied: “I would usually walk home from town. I was in the process of rehabilitation and walking is part of that rehabilitation.”

Mr Medland asked: “Is the truth of the matter that you decided not to get a taxi in order to cover your tracks?”

Evans replied: “No.”

Evans is shown CCTV footage of himself

Evans is now being shown CCTV footage of him leaving the Premier Inn through a fire door.

The prosecutor suggested he deliberately concealed his face from the security camera as he walked past, by tucking his head down.

He asked to see the footage again and told the prosecutor: “I’d say you are wrong.”

Prosecutor claims Evans "didn't care" whether woman wanted sex

The prosecutor said: “You are saying it wasn’t a time for conversation, but I suggest that is just in your mind?

“Truth to tell, Mr Evans, you couldn’t have cared less whether she whether she wanted sex or not?”

Evans replied: “She asked me to perform oral sex on her. I wouldn’t have sex with someone who wasn’t consenting.”

Mr Medland suggested it was “pitch black” in the room after Mr McDonald closed the curtains.

The defendant said there was a light outside and it was possible to see what was going on.

Evans tells court "I wouldn't hurt a girl"

The prosecutor is now asking about Evans entering the room in the Premier Inn.

He said: “You didn’t knock, did you? You let yourself in with the key? Did you think that might have been embarrassing for the girl Clayton was with?”

Evans replied: “At the time, no, but looking back, I obviously understand that would have been embarrassing.”

The prosecutor said: “There is a good period of time when Clayton McDonald is having sex with (the complainant) and you are standing there.

“Did you think to ask (her) if she minded you being there when she was having sex with Clayton McDonald?

“You, in fact, didn’t speak to her at all, throughout the whole episode?”

Evans replied: “It wasn’t really a time for conversation. We were caught up in the moment.”

He accepted he did not speak to the woman.

The prosecutor said: “Did you think it might be a good idea to ask her, not just if she minded you being in the room, but if she wanted you to have sex with her?”

Evans said that the woman asked him to perform oral sex on her.

He added: “I wouldn’t hurt a girl, I wouldn’t harm a girl.”
